"The transformation of Law in the Information Society: analysis and prospects"
Director de tessi: Dr. Pere Fabra
Descripción de la línea de investigación
The aim of the project is to analyze, from an interdisciplinary perspective, the legal consequences resulting from the implementation of digital technologies, and in particular, Internet, in our society. Digital technologies –and the so called “Information Society”- have transformed our social relations, posing new challenges in most legal disciplines. Among all of them, our research will focus on the analysis of the legal problems posed by digital networks and, in general, digital technology in the following fields: the protection of intellectual property in the Internet, the protection of personal data, consumer protection, ISP liability for third party contents and actions, electronic signature, electronic Administration, Internet government, and the new forms of e-crime, all of them within the current context of legal globalization.
During these last years, we have seen a gradual adaptation of existing regulation to the needs of the new technological context and even the adoption of new specific regulation. It is now the perfect time to start analyzing such regulation, taking into account the caselaw, contracts, and entrepreneurial practices and costumes that have developed in each sector, and evaluate their effectiveness and accuracy, under the light of the specific goals which they were set to achieve. This analysis may be undertaken from each different field, as legal research is traditionally faced. The interest of this project is precisely to add to that specialized legal analysis an interdisciplinary approach that allows the joint work and transversal enrichment of all affected fields.
