"The international normative framework of arbitration on line"

Comparative study about the normative framework of arbitration on line throughout the European States and in an international context. Nowadays jurisdiction crisis has impelled new technical means of resolution (ADRs) to emerge aside tribunals. At the same time, the bloom of regulations focused on consumer protection has allowed to intensify relationships between particulars (p2p) and between particulars and business (p2b), promoting also a substantial increase of conflicts. Arbitration, as the hetero-compositive means of extrajudicial resolution, becomes specially useful and effective in civil and mercantile conflicts. The purpose of this research is to implement the study of all foreign legislation and judicial practice –this last specially on the basis of the practice in one executory phase- in those states with rules based on arbitration on line. This work demands, consequently, as a previous step, a socio-economical analysis of the first arbitration experiences hold on line.
